Live Working (FAM)
Scope of the Legislation
GFM (Ministry of Economic Development) Decree 21/2023 (VIII. 30.) regulates the provisions and requirements applicable to live working (FAM). The regulation applies to all activities where live working occurs on electrical equipment and systems, including the production, assembly and installation of components such as batteries for electric vehicles (EVs), as well as their repair in car repair shops/service centers. This is particularly important and mandatory for companies involved in the manufacture of EV batteries and EVs, as well as EV car repairs where working with components above low voltage (DC 120V) is a daily practice.
Purpose of the Legislation
The aim of the decree is to protect the safety and health of employees and to require employers to establish safe conditions for live working. This includes providing appropriate training and certification, ensuring the availability and use of necessary protective equipment, and implementing occupational safety measures based on risk assessment.

- The decree is mandatory for all companies engaged in live working. This includes manufacturing, maintenance, repair, and operational tasks.
Training Requirements
- Employees are required to participate in specialized training for live working. These training sessions cover theoretical knowledge, practical preparation, and safety procedures. The competencies acquired must be refreshed at least every 2 years according to this legislation!
- A certificate will be issued at the end of the training, proving the employee's suitability for live working.
Occupational Safety Measures
- Employers are required to conduct a detailed risk assessment before each live working operation and to determine the necessary safety measures accordingly. Employers must provide the necessary protective equipment and other safety devices, which employees must use and wear during the activity!
Certification and Records
- The validity of the certificates is limited and must be renewed at regular intervals. Employers are responsible for keeping records of the certificates and monitoring their validity.
Deadlines
- Effective Date: November 29, 2023. The decree comes into force on this day, and from this point, employers must comply with the requirements.
- Completion of Training Requirements: December 31, 2026. By this date, all affected employees must possess the certificates required for the live working they perform. At the same time, we would like to emphasize that, according to our interpretation, due to previous regulations (e.g., the ITM decree), the training is mandatory for performing the job.
